1. GENERAL

Welcome to the online shop (e-shop) created by the company called “Eleftheria Ermeidou and CO” under the distinctive title The Art of Colour (thereafter called The Art of Colour ), having its registered offices at 27 Ag. Georgiou and Herakleitou str. Aigaleo Attica (Greece) Postal Code 12243 for products available through its website www.artofcolour. gr. The use of the e-shop is governed by these terms and conditions (hereinafter the “Terms”).

Making use of the e-shop, you automatically agree and accept fully the following terms and conditions, which you are bound to be read carefully before any use. Anyone that does not agree with these terms and conditions must not make use of the e-shop.

The Art of Colour reserves the right to modify, add and alter the content or services of the e-shop, and the terms of use whenever it deems necessary and without prior warning, just by announcing them through its website.

Eventual nullity of any terms of this present does not affect the validity of the others. The non-exercise of The Art of Colour of any of its rights atising from these Terms does not constitute a waiver of such rights . The Art of Colour is not liable for breach of these Terms by reason of a force majeure, including indicatively extreme weather conditions , earthquakes, floods, fires, emergencies etc.

In cases where the availability of any product of the e-shop is governed by specific terms and conditions, these terms are considered as a whole with these “Terms and Conditions”. However, in case of conflict , the specific terms and conditions of any product or service will prevail.

The use of the e-shop must be made exclusively for lawful purposes and in a way that does not limit or prevent the use by third parties.

Visitors should use the e-shop according to law, the morals and these present terms , and refrain from acts or omissions that may cause damage or malfunction to the e-shop, or that may affect or jeopardize the provision of services of www.artofcolour.gr.

These present terms and conditions are not applicable on the “rent a video” service which is provided by the e-shop. Such service is governed by specific terms and conditions which can be found on the “rent a video” page of the e-shop.

2. COPYRIGHT – INTELLECTUAL PROPERTY

The copyright and intellectual property of the content (eg programs, information, data) and services presented in e-shop, are protected by Greek, European and international copyright laws.

Any copying, distribution, transportation, processing, resale, creating derivative works, or misleading the public about the real provider of the content of the e-shop is prohibited. Any reproduction, republication, uploading, posting, or transmission or any other use of the Content in any manner or means, for commercial or other purposes is permitted only with prior written permission from The Art of Colour or any other copyright holder.

Names, images, logos and trademarks representing The Art of Colour or third parties and their products and services are proprietary marks of The Art of Colour or third parties protected by the relevant laws about trademarks. Their appearance in the e-shop should in no way be construed as a transfer or license or right to use them.

3. ORDER PROCEDURE

For online ordering of one or more of the products of The Art of Colour , the user should go to the page of each product of his choice and select the link «BUY IT.” Once the product or equipment are selected, an automatic check for availability will begin.

Note that we execute your order depending on our available stock, and that the availability of products appearing are indicative and not binding. If any of our products are not in stock, we are committed to communicate with you via email within 2 working days from the date of order, informing you about the period within which we will be able to deliver the product, or about the complete unavailability of any specific product.

By selecting “BUY” the procedure for temporary storage of data and purchase options in the “order’s basket “ will start. Then you can see the contents of the basket with the options: “Continue Shopping” or “Begin your order.”

If the user wishes to continue to shop, your order will remain pending , and the user may – without deleting his options – navigate the site by adding to the basket other products that he may desire. Whenever he chooses, he can return and modify the contents of the basket.

By selecting “Start your order” on the basket page, the user is transferred to the page of registration of the personal data in order to proceed to the ordering procedure.

Especially for private clients, the necessary fields are the following:

While for companies – customers the necessary fields are the following:

– Company name

– Distinctive Title / Legal Representative

– Email

– Telephone

– Shipping Address

Subsequently, by selecting the field “Payment” the customer will be transferred to a page where he is given the choice of payment method, either by cash on delivery or by credit card or by bank transfer to the bank account of The Art of Colour indicated in the page.

Each order is recorded in the online store with a “unique” order number. This number is communicated to the user by an e-mail which is sent to the e-mail address that he has entered. www.artofcolour.gr proposes to its users to keep this unique order number for their own convenience.

By virtue of law 4177/2013 (Government Gazette 173/2013) “THE CONSUMER HAS NO OBLIGATION TO PAY IF HE DOES NOT RECEIVE THE LEGAL DOCUMENT (RECEIPT – INVOICE)”

4. SECURITY OF TRANSACTIONS

The e-shop is using the protocol SSL, encryption with 128-bit (the most powerful today), for secure online transactions. In this way all your personal information, including your credit or debit card number , your name and address, are encrypted so that they can not be read or modified during their transfer to the Internet.

The protocol SSL (Secure Sockets Layer), is now the global standard for the certification of web sites to Web users and for the encryption of data between network users and network servers (web servers). An encrypted SSL communication requires that all information sent between a client and a server are encrypted by the sending software and decrypted by the receiving software, thus protecting personal information during transmission. In addition, all information sent with the protocol SSL, are protected by a mechanism that automatically checks if the data is modified in transit.

5. PRODUCT DELIVERY

The Art of Colour will send to the customer the goods ordered by him, accompanied by the relevant tax documents, providing to the customer at the same time all relevant information in accordance with applicable laws. Upon receipt of the goods ordered, the customer signs the voucher of the postal company. Products can be shipped anywhere within the Greek territory. The products will be sent to the address you have indicated in the Order Form by courier (courier). In areas where it is not possible to send your order by courier, the shipment will be made via the Greek Post within the times predicted by the Greek Post Office . Shippings will take place daily except Saturdays, Sundays and holidays.

Minimum cost of shipment is set out 3.90€. Shipments costs are free of charge for orders over 49€.

The Art of Colour, will endeavor to send your goods within 1-6 working days (Monday to Friday). For products whose availability is signed with “ON REQUEST”, “LIMITED AVAILABILITY” or “TEMPORARILY NOT AVAILABLE” and on the condition that they may be ordered from The Art of Colour’s suppliers , the delivery time will be approximately between 5 to 20 working days (Monday to Friday) depending on the product category. The place of delivery mentioned in the ” Order Entry”.

The ownership of the Product is transferred after full payment, and the risk passes on delivery.

6. LIMITATION OF LIABILITY

The online shop (e-shop) provides the Content (eg information, names, images, illustrations) and products available through the website “as is”. In any case, the e-shop is not responsible for any claims of legal or civil or / and penal nature nor for any damages (direct, special or consequential, which indicatively and not restrictively, alternatively or / and cumulatively consists in : loss of profits, loss of data , compensation, etc..) from visitors of the website or third parties related to the operation or not and / or the use of the website and / or the failure to provide information that is available from this website and / or any unauthorized third party interventions in products and / or services and / or information available through it.

The Art of Colour is not be liable to customers for any defect which was created after the time of delivery of the product, or for any defect, whose existence could not be verified due to the level of scientific and technical knowledge existing at the above time, as well as for any harm caused by using the product or service, due to an act or omission by the user or a third party.

Certain products which are available for purchasing in the e-shop are addressed exclusively to professionals of the hairdressing industry (hair colours, peroxide of hydrogene, decapage etc). The products are signed as such in the e-shop with the words “PROFFESSIONAL USE ONLY” During using these products it is necessary to strictly follow the instructions of use enclosed in the product’s packaging. The Art of Colour bears no responsibility for any harm caused (e.g allergies) or any bad performance of the products which is due to non-compliance with such instructions of use.

The Art of Colour is not responsible for the delay in execution of an order in cases of events due to force majeure. The e-shop contains links to third party websites and is not responsible for the content of these pages, or for any damage resulting from their use, as the visitor has access to them on his own responsibility.

The Art of Colour strives for the good function of the site and hence the e-shop, but can not guarantee that all technical functions will be uninterrupted, error-free, free of viruses or other harmful elements.

7. ORDER CANCELLATION

The e-shop offers a mechanism to cancel an order (in whole or in part) that has already been registered. For any cancellation of an order (complete or partial) you should send an e-mail to support@artofcolour.gr or fax at 210 5316742 . This option is provided to you, if the e-mail or fax is received by us at the latest by 14:00 of the same working day that you have pleced the order for the products.

8. PRODUCT GUARANTEE

1. Seller’s Liability for material defects or lack of properties

In case of The Art of Colour’s responsibility for material defects or lack of an agreed property of the product (“legal guarantee”), the purchaser may choose one of the following options of a) to request , to the repairment or replacement of the product with another, for free, unless such action is impossible or requires a disproportionate expenditure, b) to request a price reduction or c) to terminate the contract of sale, except for minor material defects. For a property to be considered as agreed, it must be agreed in writing. If the buyer chooses the repairment or replacement of the product The Art of Colour must repair or replace the product within a reasonable time.

These statutory (AK 540) purchaser’s rights lapse after two years for movables.

2. Supplier’s Liability and Warranty for new durable products

The new durable products (“consumer durables”) must be accompanied by a written guarantee (‘commercial guarantee’) from the manufacturer of the product or from the company that has imported the product in the EU, or from the company that presents itself as a manufacturer (“Supplier”). The basic terms of the commercial guarantee are the following:

A) The Supplier must provide to the consumer in writing, in Greek language or symbols internationally established, clear and complete instructions for the safe use, maintenance, and full use of the product and information on the risks associated with the use and maintenance of such product. The warranty should include in simple, legible and understandable terms in Greek language, at least the name and address of the guarantor, the product to which the guarantee refers, the exact content of the guarrantee, its duration and the extent of theist territorial validity. The guarantee shall be in accordance with the rules of good faith and should not be invalidated by excessive exception clauses . The warranty period must be reasonable in relation with the time for which these products are expected to remain technologically modern, if such time is shorter than their expected term of life.

B) If, during the warranty period a defect of the product appears and the Supplier refuses or delayes in repairing the product beyond the time what is necessary in the specific case , the consumer will be entitled to demand the replacement of the product with a new one of the same features and the same quality or to withdraw from the contract of sale . If the required repair time exceeds fifteen (15) working days, the consumer is entitled to request the temporary replacement of the product for the duration of the repair. The breach on the part of the Supplier of its obligations shall not affect the validity of the warranty, the consumer may invoke and require the vendor to respect.

In any case the rights of the purchaser provided for by the Greek Civil Code regarding the Seller’s Liability for defective products and the lack of agreed properties are reserved.

The waiver of such rights by the Buyer before the appearance of the defect or the lack of the agreed property, is invalid

C) In addition to the warranty, the Supplier of new durable consumer products must provide consumers with a continuous supply of technical services for the maintenance and repair for a period equal to the probable duration of their lives. Furthermore the Supplier must make available to the consumers spare parts or other products that are necessary for the use of the products throughout their expected life term.

The Art of Colour, in case it is the supplier in accordance with the above, encloses in the new durable products’ packaging the conditions relating to their safe use and maintenance, which must be observed by the purchaser.

The Art of Colour does not provide warranty, nor guaranteessuitability of the product sold for any particular purpose.

9. FORCE MAJEURE

The Art of Colour is not responsible for delays in performance (including delivery) due to circumstances not attributable to the fault of The Art of Colour or due to force majeure and therefore The Art of Colour is entitled to an extension of time for performance. Examples could include strikes, terrorist acts, war, problems of supplier / transport / production, currency fluctuations, governmental or regulatory action and natural disasters. If such circumstances last more than two months, the contract of sale may be terminated by either party without compensation.

10. MODIFICATION OF TERMS

The Art of Colour reserves the right to amend or update the terms and conditions of trade. The modification or updating shall be effective from the time that this present text is updated with any change.

11. VARIOUS

If any part of these present terms is held to be invalid or unenforceable by a court, the remainder of the agreement shall continue in effect. The Art of Colour may enter into an agreement for the assignment of duties to an appropriate third party. Otherwise, neither party shall be entitled to assign or transfer its rights or obligations. All notices must be in writing or by hand, by email, fax or letter via first class mail, which will be deemed delivered 48 hours after posting.

12. APPLICABLE LAW - JURISDICTION

This agreement is governed by the European and Greek law, especially the laws regulating issues related to electronic commerce, distance selling and consumer protection, and is subject to the exclusive jurisdiction of the courts of Athens.
